OPM Medical Disability Retirement

OPM Lawyer

Non-military federal workers who are unable to perform their duties because of a disability are required to choose between specific types of benefits. Employees who are separated from their jobs should apply for federal workers' compensation benefits in addition to medical disability retirement via the Office of Personnel Management (OPM). They must apply for the latter so they can retain their rights under their federal retirement programs.

OPM medical disability retirement benefits are distributed to government workers who are incapable of performing their jobs with reasonable effectiveness and efficiency. Their disabilities have essentially disabled them from doing their jobs. These claims can be appealed to the Merit System Protection Board, a body of judges who sit in Washington, DC. If a person's claim is denied at that level, he or she can appeal to the United States Court of Appeals for the Federal Circuit.

OPM medical disability retirement claims are intricate requests that should be completed as if you would be appearing in front of the United States Court of Appeals. If you are a non-military federal employee who is unable to deliver useful and efficient service because of a specific disability, the laws of the United States are designed to protect you. As an acclaimed OPM lawyer, we will make sure you know these rights and you get what's rightfully yours.

OPM Attorney

Applying for and receiving OPM medical disability retirement benefits has taken many people several years. It's important to note: should you try to return to your previous federal job while waiting to obtain approval from the OPM, you could possibly lose a large chunk of your benefits. The OPM regards any return to your old job as an actual, bona fide return to work regardless of how long the return is.

If you are a federal civilian employee separated from your job because of a disability, your OPM medical disability retirement application must be completed and delivered to the OPM within a year of your official separation date. If you fail to file an application within this time frame, you will be denied your OPM medical disability benefits. Moreover, if you fail to produce your disability application within the aforementioned timeframe, those who survive you will be denied your death benefits.
