The attorneys fee amounts are pre-set by the Government. The government has currently set the attorney fee amount at a fee equal to the lesser of 25% of the past due benefits resulting from your claim(s) awarded to yourself and or your family or the dollar amount established by Title 42 U.S.C. Sec. 406(a)(2)(A) which is currently set at $6000.00 but which may be increased by the Commissioner of Social Security. The fees are paid by the SSA to the attorney out of your backpay benefits. You remain responsible for all costs that may be incurred in your claim. Costs include such items as your medical reports, doctor's examinations, vocational rehabilitation evaluations, etc. Representation is finite and limited to administrative level claims only; federal court appeal representation if necessary and offered requires entering new and separate representation.
Veterans Disability Claims (Administrative level, no federal court appeal)

The attorneys fees in veterans disability claims are the same nationwide for all attorneys.
The attorneys fee amounts are pre-set by the Government. The government has currently set the attorney fee amount at a fee of 20% of the past due benefits resulting from your claim(s) awarded to yourself and or your family established by 38 C.F.R. Sec. 20.609(h). You remain responsible for all costs that may be incurred in your claim. Costs include such items as your medical reports, doctor's examinations, vocational rehabilitation evaluations, etc. Representation is finite and limited to administrative level claims only; federal court appeal representation if necessary and offered requires entering new and separate representation.
Federal Workers' Compensation Claims (OWCP)
For OWCP federal workers' compensation claims, by federal regulation, you, the claimant are 100% responsible to pay attorneys fees.
The OWCP will not pay nor assist you in the payment of any attorneys' fees. The OWCP will not reimburse you for any fee and is not liable for your payment of any fee. Contingency fees are administratively prohibited in OWCP claims. 20 C.F.R. Sec. 10.702 et seq.
Attorney fees are due and payable regardless of case outcome. The attorneys fees in OWCP claims vary widely nationwide for all attorneys.

OPM Medical Disability Retirement (FERS, CSRS) Claims (Administrative level, no federal court appeal)
You are responsible for all fees and costs that may be incurred in your claim. Costs include such items as your medical reports, doctor's examinations, vocational rehabilitation evaluations, etc. Representation is finite and limited to administrative level (MSPB) claims only; federal court appeal representation if necessary and offered requires entering new and separate representation. Depending upon the issues and the case facts, fees average from $2500 to $4000 or may be offered on a contingency basis.
